MP 928/2020 Suspension of employment contract for 4 months revoked

As soon as Provisional Measure no. 927/2020 was published, the provision providing for the suspension of the employment agreement for a period of up to 4 (four) months for the employee to participate in courses or professional qualification programs offered by the employer, without receiving salary, was heavily criticized.

As a result, on 03/23/2020, in an extra edition of the Official Gazette, Provisional Measure no. 928/2020 was published, revoking article 18 of Provisional Measure no. 927/2020, which dealt with this suspension.

It should be emphasized that, regardless of such MPs, CLT, in article 476-A, provides for the suspension of the employment agreement for a period of 2 (two) to 5 (five) months so that the employee may participate in a professional qualification course or program.

However, in this case there is the need for authorization in a collective agreement or convention and, in addition, the suspension must be communicated to the union at least 15 days in advance.
