Trademarks and patents - Coronavirus effects on INPI's operation

Once again the suspension of deadlines of all processes of the Brazilian National Institute of Industrial Property (INPI), was extended. By INPI PR Ordinance no. 179, of May 12, the deadlines remain suspended until May 31, 2020. The suspension of deadlines previously extended would end on May 15.

The INPI maintains as objective the prevention of infections and the spread of COVID-19, considering that the extension is also applied for teleworking to the INPI's own servers and employees.

What about deadlines with this update?

 

We clarify that, like the previous suspensions already published by the BPTO, the use of the suspension of deadlines until May 31 is optional, and the user may file petitions and respond to the proceedings normally during this period.

Our recommendation is to opt for the extension of the deadline only as a last resort.
