In a recent publication, Resolution CD/ANPD No. 1, of 28 October 2021 established the details of the procedures that apply to the inspection process, bringing explanations about the monitoring activities, guidance and preventive action of the body, aiming to repress violations of Law No. 13,709/2018 (General Law of Personal Data Protection - LGPD), as well as the rules that must be observed in the administrative process for punishments, by the National Data Protection Authority - ANPD. This is a major and important step to start the dissemination of the regulations by the ANPD.
Other points are also addressed, such as the duties of the Regulated Agents (for example, the obligation to provide copies of documents, allow access to facilities, equipment, applications, audits conducted or determined by the ANPD, among others), as well as other procedural provisions.
