Did you know that medium-sized and large companies have until May 30, 2014 to implement their Electronic Judicial Domicile in order to receive summonses?

We are available to answer any questions about the implementation of the Electronic Judicial Domicile, since the deadline for medium and large companies to comply with this rule is May 30, 2024.

The Electronic Judicial Domicile is a platform of the "Justice 4.0 Program" of the National Council of Justice (CNJ) that centralizes the communications of cases from all Brazilian courts. As of March 1, 2024, medium and large companies must join this platform, where subpoenas and summonses will be sent electronically, with specific deadlines for opening and reading. Failure to meet the established deadlines may result in penalties, making it compulsory to join 90 days after the initial deadline.

We understand that litigation management can be complex, especially when outsourced or handled by several areas within the same company, so it is crucial to create an internal procedure to be observed in order to avoid missing procedural deadlines and, consequently, possible losses. The deadlines for opening summonses and reading subpoenas in the Electronic Judicial Domicile are 3 (three) working days for summonses and 10 (ten) calendar days for subpoenas.

We would like to point out that, in the event of non-confirmation of receipt of summonses, companies are subject to a fine of up to 5% (five percent) of the value of the case for an act detrimental to the dignity of justice.

Our Civil Litigation team is on hand to explain this information further and ensure that all our clients are prepared for this transition.
