Circular Letter No. 4,037/2020

The Central Bank amends, through Circular No. 4,037/2020, some provisions of Circular No. 4,032/2020, which deals with Open Banking.

Below are the changes provided for in the Circular:

  • The extension of the deadline for the formalisation of the initial structure responsible for the governance of the Open Banking implementation process to 24.07.2020;
  • The inclusion of an attribution to the Deliberative Council, namely: to approve proposals for technological standards, operational procedures and other aspects necessary for the implementation of Open Banking in the country;
  • The composition of the groups and 1 and 2 of the Deliberative Council, which will be up to 3 councilors;
  • In case of formal withdrawal of the elected association or group of associations, the representation of its respective subgroup will remain vacant, not being counted for the definition of majority in deliberative processes;
  • The deadline for notifying the Secretariat of the replacement of titular or alternate directors shall be 2 working days;
  • The number of unjustified absences from meetings that may lead to dismissal, which is now 2 consecutive meetings or 3 non-consecutive meetings;
  • The need for the consent of at least 3 directors for the calling of extraordinary meetings of the Deliberative Council; and
  • The composition of the Advisory Board for deciding on resolutions related to the approval of the structure's budget; contracting services; and changing the structure responsible for governance; for the qualified majority of directors, considered as the total number of directors reduced by one.
