Trademarks and Patents - Coronavirus Effects on BPTO's Operation

The Brazilian National Institute of Industrial Property (INPI) has granted users the possibility of using the suspension of deadlines between March 16 and April 14. (INPI PR Ordinance no. 120 of March 16). Those who wish to continue with the deadlines in standard count in order not to harm the progress of the proceedings, may.

The BPTO itself remains working at normal pace, and the publications of the status and progress of the proceedings will not be affected. Thus, the Industrial Property Journal (RPI) will continue to be made available normally every Tuesday.

What happens to the deadlines for users?

It is important to clarify that the use of this additional period is optional. The user may file and respond to the proceedings normally during this period. To reduce the chances of delays in trademark and patent prosecution, we recommend that users opt for the possible extension of the deadline only as a last resort.

The BPTO also suspended in-person services and instituted remote work for all its teams, keeping its headquarters in Rio de Janeiro and the other regional units closed as of March 20, for an indefinite period.
