Experts explain what will change with betting regulation

The fact that, nowadays, all bookmakers are based abroad, this ends up creating a scenario of instability in the sector

Regulate the sports betting market in the country, this is the goal of the Ministry of Finance to announce the issue of a Provisional Measure to organize online games. Among the measures are a grant of R$ 30 million and a tax rate of 15% on all revenue minus the premiums paid.

The Football Etc column heard the opinion of three experts to know what will change in the universe of online betting, from this government decision.

Let the regulation come soon

"The market is hoping that this regulation comes soon, because the appetite of operators to enter Brazil is great, the Brazilian State's need for more resources is great, and the gamblers' need and demand for more protection is great. The most important thing in this whole story is that the kickoff has been given. We cannot run the risk of seeking an optimal regulation, an exceptional regulation. The best regulation is the one we have, and it is much better than the current framework, in which we have nothing at all. So, I think it's very prudent to take the first step with what the Ministry of Finance considers to be mature, so that possible changes and improvements can be made during the process in Congress" - Fabiano Jantalia is a lawyer specialized in Gaming and Banking Law, founding partner of Jantalia Advogados.

It will end instability

"The information is still speculative; only with the text approved and published will we have the dimension of the impact that the regulation will generate in the market. However, we welcome the intention to regulate the activity as soon as possible. Currently, all bookmakers are based abroad, creating a scenario of instability for the platforms and, especially, for users, besides causing the country to lose revenue. A proper regulation will bring stability and bring investments to the market, besides awareness policies for users and eventual sponsorships, advertising and publicity" - Marcelo Mattoso is a specialist in the Games and eSports market, partner at Barcellos Tucunduva Advogados.

Care with advertising

"The regulation will also reach advertising, since it arises, above all, from the fact that sports betting is a restricted or even inappropriate product for certain audiences and age groups. So the communications in the media, the advertisements, must be safe, well defined, structured as the legislation allows, socially responsible and ethical. In short, a lot of transparency is needed in these kinds of cases, especially because this is still an incipient market in the country, whose excessive consumption and exaggerated supply can be quite treacherous and harmful to society as a whole. Otherwise, betting will cease to be entertainment and become a public health case (pathology, addiction, compulsion), with the potential to culminate in over-indebtedness and economic and financial bankruptcy of bettors/consumers" - Felipe Crisafulli - Sports Law Specialist at Ambiel Advogados.
