Changes in Control and Qualifying Holding of SCD and SEP

New rules related to the authorisation process of DSCs and SEPs (among other authorised institutions) have been issued by the Central Bank.

Among the changes brought by CMN Resolution No. 4,970 of November 25, 2021, the definitions and percentages of control and qualified participation are equalized to those used today by Payment Institutions.

It will also become equally mandatory that the direct control held by a legal entity be held by a Financial Holding Company or an authorised Institution, as already occurs with Payment Institutions.

There remains, however, the possibility of the Investment Fund being a controlling shareholder of SCD and SEP.
