BCB Resolution No. 293/2023, establishes that "Pix participants that, on December 1, 2022, had an existing contractual relationship with third parties reached by the provisions of item I of art. 90-A must adjust their Pix-related transactions with a view to ensuring adherence to the Pix Regulations."
As well as adjust operations, third parties must:
(i) have submitted their request to adhere to Pix by May 31, 2023;
(ii) adjust contracts entered into before December 1, 2022; and
(iii) hire a responsible participant to enable their participation in Pix.
In other words: the operation being regular is insufficient. The documents that formalize the relationship between Pix participants, as well as between Pix participants and users, must reflect these conditions to ensure complete adherence to the Pix Regulation (Regulamento do Pix).
