The recent changes in the Pix Regulation should also be reflected in the end-user contracts

Due to the changes in Pix's Regulation, partnerships and outsourcing of services started to be regulated by Bacen, which established rules that must be included in the contracts signed between participants and partners.

However, some of the recent changes also entail the need to amend the contracts signed with end users, in order to demonstrate the regularity of the operation, in addition to the express indication of certain obligations set forth in the Regulation.

In this regard, it is important to emphasize that participants are responsible for complying with the requirements set forth in the Regulation when offering services to end users. They must allow the Central Bank access to the contracts and other documents of the partners, and adopt preventive and corrective measures if any irregularity is found.

On the other hand, payment service providers that intend to partner with Pix must ensure that their contracts are in line with the regulatory provisions, given the possibility of surveillance by the participant with whom they have a contractual relationship.
