Resolution BCB nº 264/2022, already in effect, modifies rules for card receivables

It is worth remembering that the regulation determines the mandatory registration of receivables from the receiving end users in registration systems authorized by the BCB, to which lenders and accreditors should connect to negotiate them.

The objective of the Central Bank is to minimize the difficulties and challenges for accrediting institutions, subcreditors, and lenders. Besides promoting important advances, bringing more transparency, efficiency, and security to the negotiations, it also confers more regulatory comfort for eventual BCB action.

The following are proposed changes to the regulatory framework for registration and trading of payment arrangement receivables, which have been incorporated into the Resolution:

I - Establishment of the form of calculation of the value of receivables consisting of a unit of receivables;

II - Provision of a command of a principle nature to be followed by the acquirers for the blocking of amounts of receivables from the receiving end-user in order to: a) make offsets with amounts owed by the receiving end-user; and b) constitute financial reserves for contractual risk management with the receiving end-user;

III - prescription for the accrediting entities to request from the registration systems the deconstitution of liens and encumbrances associated with contracts for the promise of assignment of receivables or contracts that produce equivalent effects in up to two working days, as from the date of communication of the rescission of the contract by the receiving end user;

IV - Obligation for the accrediting entities to verify, in the registration systems, the existence of contracts of receivables from payment arrangements whose effects reach the new schedules of receivables of these users, prior to the execution of contracts of promise of cession of receivables or contracts that produce equivalent effects in relation to these users;

V - Determination and expansion of the scope of reconciliation of the information exchanged between: a) the acquirers and the registration systems; b) the financial institutions and the registration systems; and c) between the registration systems, within the scope of interoperability;

VI - Provision for the identification, by the registration systems, of transactions that are potentially in disagreement with criteria established in art. 4, §2, of Resolution No. 4,734/2019;

VII - Determination to the registration systems and accreditation agencies to institute uniform processes with established deadlines for accepting, processing and answering challenges from their participants and receiving end-users;

VIII - determination to the accrediting companies to make available to their receiving end users, by means of an electronic interface, a channel for: a) access to information about their registered receivables agendas; and b) sending of contestations to the registration systems;

IX - Prohibition for the registration systems to perform additional automated requests for the constitution of liens and encumbrances on agendas of receivables for which the initial request, referring to the contract, has been successful;

X - Regulatory reinforcement as to the obligation of the registration systems to extend to new registered agendas the effects of contracts that reach them, respecting the chronology of delivery of these contracts;

XI - Standardization of events and the ways of charging fees in the interoperability environment, as well as the mandatory use of this standardization by services provided to the direct participants of the registration systems;

XII - Generation of reports of compliance of the accreditors and subaccreditors to the operating rules of the trading environment and registration of payment arrangement receivables and making available the reports of the subaccreditors to the respective accrediting institutions; and

XIII - Other minor changes.
