Provisional Measure 930 - Changes in the Law that Regulates the Payment Market

Provisional Measure No. 930 was published this week (30.03.20), which, among other measures, amended Law No. 12,865, of October 9, 2013, which provides for payment arrangements and payment institutions belonging to the Brazilian Payment System.

The MP included new articles in the referred legislation (articles 12-A, 12-B and 12-C), establishing that the amounts received by the companies in the payment chain (issuers, acquirers and subaccreditors) constitute segregated assets and cannot be subject to seizure, attachment or any judicial constriction for debts of such companies.

The measure aims to ensure that the commercial establishments receive the values of transactions carried out with cards, ruling out any creditor of the payment companies in the constriction of these values.
