Contents in Online Games

Most online games possess Terms of Use to establish how their legal relationships will be governed.

In most cases, the contents unlocked within the game do not belong to users, but are rather the developers’ intellectual property. When creating an account, users are granted a license that remains in force as long as they comply with the rules of the game.

As a rule, transferring content between accounts is not allowed, unless the developer expressly authorizes this to occur.

In-game “digital currency” balances are not refundable for the following reasons:

  • They are not really currencies, since they only exist in a fictional way within a game, and are nothing more than a feature to release content in the way users prefer;
  • When users employ real money to release a certain “digital currency” within the game, what they are acquiring is the right to a license to play, not making a deposit to a bank account or payment account.

IMPORTANT: User licenses can be revoked if a user breaches the contract.
