New NR-1: Companies must prioritize Mental Health as of May 2025

As of May 2025, the updated NR-01 comes into force, imposing new responsibilities on companies in relation to occupational risk management, including workers' mental health.

This change is a significant innovation in occupational safety and health standards and requires immediate attention to ensure compliance.

Deadlines and Main Obligations:

  • Start of validity: May 2025.
  • Occupational Risk Management (ORM): Implement a comprehensive program that includes the analysis of psychosocial factors at work.
  • Ergonomic Work Analysis (EWA): Mandatory update to include aspects related to mental health.
  • Reports and Plans: Companies must make detailed documentation on the risks and preventive measures implemented available to labor inspectors and other interested parties.

Points of attention:

  • Focus on Mental Health: Identify and mitigate factors such as harassment, work overload and other conditions that can impact on employee well-being.
  • Worker Participation: Incorporate employee perceptions into risk assessment processes.
  • Action Plans: Draw up detailed timetables for implementing the necessary measures.
  • Labor Claims: the documents dealt with in NR-1 will be important for defending companies in possible lawsuits involving mental health claims.

Penalties for Non-Compliance: Companies that fail to meet the requirements could face:

  • Fines: With amounts proportional to the seriousness of the infraction.
  • Prohibition of Activities: Temporary suspension of sectors or operations.
  • Judicial accountability: In more serious cases, judicial and even criminal implications.
