Trademarks and Patents - Coronavirus effects on INPI's operation

The suspension of deadlines for all proceedings at the Brazilian National Institute of Industrial Property (INPI), which would end today, April 30th, was extended once again. By INPI PR Ordinance no. 166, of April 28, the deadlines remain suspended until May 15.

INPI's goal remains the prevention of infections and the spread of COVID-19, considering that the extension is also applied to the telework of INPI's own servers and employees.

What about deadlines with this update?

We clarify that, like previous suspensions already published by the BPTO, the use of the suspension of deadlines until May 15 is optional, and the user may file petitions and respond to the proceedings normally during this period.

Our recommendation is to opt for the extension of the deadline only as a last resort.
