MP no. 948 amends CDC due to COVID-19

President Jair Bolsonaro edited on 08/04/2019, the MP No. 948 that regulates the reimbursement of cultural events and tourist services that were affected due to COVID-19.

Thus, in case of cancellation of services, reservations and events, including shows and spectacles, there is no obligation to refund the amounts paid by the consumer, provided that the service provider ensures the rescheduling of services or the availability of credit, and the parties may also formalize any other type of agreement.

The rescheduling of events may not entail any type of extra charge to the consumer, who has a period of ninety (90) days as of the date MP 948 came into effect.

The credit made available to the consumer must be used within twelve months, which will begin once the state of public calamity recognized by Legislative Decree No. 6 of 2020 is ended.

The MP also ensures that the artists and other professionals hired for these events have no obligation to return the fee or amounts paid for the services.

Finally, the MP emphasizes that the case in question is characterized as an act of God or force majeure and does not give rise to moral damages, application of fine or other penalties.

The referred MP was published in an extra edition of the Federal Official Gazette (DOU) and has immediate validity for the next 60 days, but still needs to be approved by the National Congress.
